By accessing or using Modernaview, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use our services. These terms apply to all users, including free and paid subscribers.
Modernaview provides AI-powered virtual staging, room redesign, and wall painting visualization tools for real estate professionals and homeowners. Our service uses third-party AI models including Google Gemini and OpenAI to generate image transformations. We reserve the right to modify, suspend, or discontinue any part of the service with reasonable notice.
You must be at least 18 years old to use Modernaview. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate, current, and complete information when creating your account. You may not share your account with others or create multiple accounts to circumvent usage limits.
Credits are deducted upon generation. Credits used in failed generations are automatically refunded to your account. Purchased credit packs are non-refundable. Subscription plans are billed monthly in advance through Stripe. You may upgrade or downgrade your plan at any time — upgrades are prorated and charged immediately, downgrades take effect at the next renewal. We reserve the right to change pricing with 30 days notice to active subscribers.
You may not use Modernaview to generate illegal, harmful, misleading, or deceptive content. You may not upload images that contain nudity, violence, or content that violates the rights of others. You may not attempt to circumvent usage limits, rate limits, or security measures. AI-generated images used in real estate listings must be clearly disclosed as virtually staged or AI-generated to comply with real estate advertising regulations in your jurisdiction.
You retain full ownership of images you upload. You own the AI-generated outputs produced from your uploads and may use them for personal and commercial purposes, including real estate marketing. You grant Modernaview a limited, non-exclusive license to process your uploaded images solely to provide the service. We do not claim ownership of your content. Generated images include a SynthID watermark applied by Google — this is an invisible AI-identification watermark and does not affect commercial use.
Generated images are AI-created visualizations for marketing and staging purposes only. They may not accurately represent construction feasibility, actual material costs, structural changes, or final renovation results. Generated images must not be used as architectural plans, building permits, or professional design specifications. Modernaview makes no warranty that generated images comply with local building codes or regulations.
Brokerage and organization plan holders are responsible for ensuring all team members comply with these terms. Organization administrators may manage member access and credit allocations. Modernaview is not liable for actions taken by organization members under a shared account.
To the maximum extent permitted by law, Modernaview is not liable for any indirect, incidental, special, or consequential damages arising from your use of the service, including loss of profits, data, or business opportunities. Our total liability for any claim is limited to the amount you paid to Modernaview in the 12 months preceding the claim.
We may suspend or terminate accounts that violate these terms, engage in fraudulent activity, or abuse our systems. You may delete your account at any time from Settings. Upon termination, your access to generated images may be lost — we recommend downloading any images you wish to keep.
These terms are governed by the laws of the United States Virgin Islands. Any disputes shall be resolved in the courts of the United States Virgin Islands.
